During a recent session of the International Maritime Organization (OMI) Assembly that took place few weeks ago in London, Panama was re-elected in Category A in the Voting Council of OMI.  The other countries also elected within Category A are: Italy, Japan, Norway, South Korea, Russian Federation, United Kingdom, United States of America, China and Greece, all considered maritime leadership countries.

According to representatives of the Panama Maritime Authority (PMA), the re-election of Panama in this category is a clear recognition from the international maritime community to all the efforts that Panama has been accomplished to follow the international obligations and responsibilities applicable to vessels under Panama flag.  They pointed out that the Panamanian Registry is managed by the Government through PMA and all the different Merchant Marine Consulates worldwide offering legal security to shipowners, different than the scheme offered by other flag states through registries managed by private companies.

The Panama Maritime Authority (PMA) recently approved some extra discounts to those vessels to be enrolled under the Panamanian flag during the year 2014, regardless that the vessels are also subject to other discounts already contemplated by law.  With this important measure, the Republic of Panama seeks to keep its maritime leadership as Flag State and promote the growth and quality of the Panamanian merchant fleet.

Among the vessels that can be benefit with these new extra discounts are the following:

  • New construction vessels to be enrolled individually during 2014, regardless their tonnage, may be benefit with an extra discount of 35% over registration fees and annual consular fees for 1 year period.  This discount has to be requested by shipowner at the moment of enrollment and through the vessel’s resident agent.
  • New construction vessels part of large economic groups of shipowners that have a worldwide commercial impact or that represent an important interest for the Panamanian Merchant Marine, only if enrolled during 2014. In this case, these vessels may be benefit with an extra discount of 15% over registration fees and annual consular fees for 1 year period. This discount has to be requested by shipowner at the moment of enrollment and through the vessel’s resident agent.  It is necessary to submit respective document stating that the new construction vessel is part of a large economic group registered in the Panamanian Merchant Marine.
  • Vessels with less than 15 years of construction (counted since their keels were laid) and with more than 10,000 TRB, only if enrolled during 2014.  These vessels may be benefit with an extra discount of 25%over registration fees and annual consular fees for 1 year period. This discount is automatically granted by PMA at the moment of enrolled only if a technical document issued by a Recognized Organization or a Class Society state the tonnage and the date when the keel of the vessel was laid.

It is important to point out that these extra discounts are granted by PMA only if the vessels in cases above mentioned are enrolled under Panamanian flag during the year 2014

The total of discounts granted by law and this new measure can’t be more than 100% of registration fees and annual consular fees for each vessel.

             

La Autoridad Marítima de Panamá (AMP) recientemente aprobó dispensas adicionales para aquellas naves que se registren bajo la bandera panameña durante el año 2014, a pesar de que las naves también tengan derecho a un descuento especial contemplado en la ley.  Con esta importante medida, la República de Panamá busca mantener su liderazgo marítimo como Estado Bandera y promover el crecimiento y calidad de la flota mercante panameña.

Entre las naves que tendrán como beneficio las nuevas dispensas y descuentos están las siguientes:

  • Naves de nueva construcción, sin importar su tonelaje, que se abanderen individualmente, recibirán una dispensa adicional del 35% sobre la tasa de registro y en la tasa anual consular por el término de 1 año.  Esta dispensa debe ser solicitada por el propietario al momento de abanderar y a través de su agente residente.
  • Naves de nueva construcción que pertenezcan a grandes grupos económicos, de armadores o propietarios de impacto comercial mundial o que representen algún interés para la marina mercante panameña y que se abanderen durante el año 2014.  En este caso, estas naves recibirán una dispensa del 15% sobre la tasa de registro y en la tasa anual consular por el término de 1 año. Esta dispensa debe ser solicitada por el propietario al momento de abanderar a través de su agente residente y debe presentarse un documento idóneo que acredite que la nave de nueva construcción pertenece a un grupo económico inscrito en la Marina Mercante Nacional.
  • Naves menores de 15 años de construcción desde la puesta de quilla y que tengan un tonelaje bruto mayor de 10,000 TRB, que se abanderen en el año 2014, recibirán una dispensa adicional del 25% sobre la tasa de registro y en la tasa anual consular por el término de 1 año.  Esta dispensa es otorgada por la AMP de forma automática, pero al momento de abanderar debe entregarse un documento técnico emitido por una Organización Reconocida o de Clasificación para comprobar el tonelaje y la fecha de puesta de quilla.

Es importante destacar que las dispensas adicionales otorgadas por la AMP únicamente aplican para naves que se registren bajo bandera panameña durante el año 2014

La sumatoria de los descuentos otorgados por ley y de las adendas recientemente aprobadas no podrá ser mayor del 100% de los derechos de registro y la tasa anual consular de cada nave.
