REGISTRY OF INTELLECTUAL PROPERTY RIGHTS IN THE COLON FREE ZONE AND THE NATIONAL CUSTOMS AUTHORITY
In order to obtain a better control and protection of the Intellectual Property Rights, our Legislation considers a complementary registry of the ownership of the Intellectual Property Rights in the National Customs Authority as well as in the Colon Free Zone in Panama.
Every petition before the National Customs Authority and the Colon Free Zone shall be based on a trademark registered before the General Directorate of Registry of the Industrial Property (DIGERPI, in Spanish).
Hereinafter, we detail the Competence of these entities:
- National Customs Authority
By means of Decree Law 1 of February 13, 2008, it is created the National Customs Authority and other provisions of Customs Procedures.
According to Article 19 of this Decree:
«The National Customs Authority is the superior body of the national customs service and is the institution of the State in charge of controlling, supervising and monitoring the entrance, exit and movement of merchandises, persons and means of transport by the frontiers, ports and airports of the country, for purposes of tax revenues imposed or for the applicable controls, as well as to prevent, investigate and penalize the customs infringements, obtain statistics on external commerce, interfere in the international traffic of merchandise and comply with the duties conferred by means of the international agreements of which the Republic of Panama is a party.
The Free Zone is empowered to inspect and/or withhold merchandise in transit in the territories it operates, that could be infringing provisions of the laws of Industrial Property, Copyright and Related Rights. The Free Zone performs inspections, at its discretion. For inspection purposes, the Free Zone shall consider factors such as: merchandises consigned in the name of companies appearing in the list of alleged infringers provided by the holders of rights involved or their registered proxies; consignors of counterfeit merchandise; recurrence in said behavior and/or any other factor indicated by the rendering of service and the commercial practices.
- Advantages of obtaining this registry
It serves as a database and an immediate reference for the National Customs Authority and the Colon Free Zone at the time of an investigation due to the commission of any type of infringement or counterfeiting or misuse of an Intellectual Property right. In such away, they verify in their files if a trademark appears registered in Panama and furthermore confirm the data thereof without need of delaying the process by contacting the General Directorate of Registry of the Industrial Property (DIGERPI, in Spanish).
The registry of the trademark in these entities allows them to detect more rapidly counterfeit goods and to speed up the processing of information necessary when it is required for seizure of these counterfeit products (if such is the case).
General Power of Attorney of the corporation, duly notarized and legalized with Apostille or via a Panamanian Consulate.
Authenticated copy executed by the Panamanian Office of Trademarks, of the Registry Certificate of the trademark, resolution of concession and/or any other document registered at the DIGERPI, such as: resolutions on renewals, transfer, change of domicile, change of name, use licenses to mention some.
REGISTRO DE DERECHOS DE PROPIEDAD INTELECTUAL EN LA ZONA LIBRE DE COLÓN Y LA AUTORIDAD NACIONAL DE ADUANAS
A fin de procurar un mejor control y protección de los derechos de Propiedad Intelectual, nuestra Legislación ventila un registro complementario de la titularidad de los derechos de Propiedad Intelectual tanto en la Autoridad Nacional de Aduanas como en la Zona Libre de Colón en Panamá.
Toda solicitud ante la Autoridad Nacional de Aduanas y en la Zona Libre de Colon deberá basarse en una marca registrada ante la Dirección General del Registro de la Propiedad Industrial (DIGERPI).
A continuación detallamos la Competencia de estas entidades:
- Autoridad Nacional de Aduanas
Mediante Decreto Ley 1 del 13 de febrero de 2008, se crea la Autoridad Nacional de Aduanas y otras disposiciones de Régimen Aduanero.
Conforme al Artículo 19 de este Decreto: “La Autoridad Nacional de Aduanas es el órgano superior del servicio aduanero nacional y es la institución del Estado encargada de controlar, vigilar y fiscalizar el ingreso, salida y movimiento de las mercancías, personas y medios de transporte por las fronteras, puertos y aeropuertos del país, para los efectos de la recaudación tributaria que los gravan o para los controles que les son aplicables, así como de prevenir, investigar y sancionar las infracciones aduaneras, de formar estadísticas sobre comercio exterior, intervenir en el tráfico internacional de mercancías y cumplir con las funciones que se le confieran, mediante acuerdos internacionales de los que forme parte la República de Panamá”.
La Zona Libre tiene la facultad para inspeccionar y/o retener, mercancías en tránsito por los territorios donde opera, que puedan estar infringiendo disposiciones de las leyes sobre Propiedad Industrial, Derechos de Autor y Derechos Conexos. La Zona Libre lleva a cabo sus inspecciones discrecionalmente. Para efectos de la revisión, la Zona Libre podrá tomar en cuenta factores tales como: mercancías consignadas a nombre de compañías que aparezcan en las listas de presuntos falsificadores suministradas por los titulares de los derechos afectados o sus apoderados registrados; precedentes de consignatarios de mercancías falsificadas; reincidencia en dicho comportamiento y/o cualquier otro factor que la prestación del servicio y que las prácticas comerciales indiquen.
- Ventajas de obtener este tipo de registro
Sirve de base de datos y referencia inmediata para la Autoridad Nacional de Aduanas y la Zona Libre de Colon al momento de una investigación por la comisión de cualquier tipo de falta o delito de falsificación o uso indebido de un derecho de Propiedad Intelectual. De esta forma, comprueban dentro de sus propios expedientes si una marca está registrada en Panamá y asimismo confirman los particulares de la misma sin la necesidad de dilatar el proceso contactando a la Dirección General del Registro de la Propiedad Industrial (DIGERPI).
El registro de la marca ante estas entidades, les permite detectar productos piratas con mayor rapidez y acelerar el procesamiento de la información necesaria cuando la misma sea requerida con la finalidad de realizar secuestros de estos productos falsificados (de ser el caso).
Poder General de la sociedad debidamente notariado y legalizado por el Sello de la Apostilla o a través del Consulado Panameño.
Copia autenticada otorgada por la Oficina Panameña de Marcas del Certificado de Registro de la marca, del resuelto de concesión y/o cualquier otro documento inscrito ante la DIGERPI, entre los cuales se pueden mencionar: resueltos de renovación, traspaso, cambios de domicilio, cambios de nombre, licencias de uso, entre otros.
